$980K Verdict Upheld for Mesothelioma Victim

A victory in the courtroom for a victim of asbestos exposure is always great to hear about. It means that justice has been served to those who knowingly exposed someone to a toxic substance, which can lead to a serious illness or even death.

It can be very disappointing to learn of the defendants of those trials appealing the verdict that the jury could have taken weeks or months to come to. Recently, the U.S. Court of Appeals for the Second Circuit upheld a $980,000 verdict in the asbestos lawsuit of mesothelioma victim, Kit McCormick.

Mr. McCormick was exposed to asbestos through his occupation as a boiler worker at the McConnell Air Force Base from 1974 through to the early 1990's. In the verdict, Cleaver Brooks Company, a boiler manufacturer, was found 60 percent liable for Mr. McCormick's injuries leading to his mesothelioma diagnosis. Cleaver Brooks was the defendant to appeal the $980,000 verdict.

Despite Cleaver Brooks' argument that they were not responsible for Mr. McCormick's asbestos exposure, the judge upheld the verdict. Congratulations to the family of Mr. McCormick, who passed away in 2005 from his malignant mesothelioma. It is they who will feel the absence of Mr. McCormick the most.
